Delta Air Lines, Inc v Ontro Ltd- O/044/21

An appeal from the decision of the Trade Mark Office's refusal to reject numerous classes of goods/services from Ontro's specification for the mark SkyClub, the name of Ontro's famous on-line travel agency. Delta claimed that Ontro had failed to plead to Delta's TM7 but Delta had itself failed to provide an accompanying Statement of Grounds. That ground of appeal was rejected and Ontro Ltd permitted to amend its Counterstatement on appeal. Delta's 2nd ground of appeal rejected as it related to claims to a closer proximity between its travel lounge services and those of Ontro Ltd including foods services.
